Article 4: The Agreement

The Agreement between Botanisan and the Client is established upon order confirmation. Botanisan may cancel orders if payment cannot be processed or in case of stock unavailability.

Article 5: Right of Withdrawal

• Main Products (Plants): Due to their perishable nature, these items cannot be returned.
• Other Products: Clients may withdraw from the agreement within 14 days of receiving the product, provided the product is unused and in original condition.

Article 6: Exercise of the Right of Withdrawal

Clients must notify Botanisan via contact@botanisan.com within 14 days to exercise their right of withdrawal. The return shipping costs are borne by the Client. Refunds are processed within 14 days of receipt of the returned product.

Article 7: Compliance and Warranty

Botanisan ensures that products conform to the descriptions provided on the site. Warranties are valid only if products are used as instructed.

Article 8: Price and Payment

Prices are in euros and include VAT. Payment must be made at the time of order using approved methods. Botanisan reserves the right to adjust prices.

Article 9: Delivery and Execution

Orders are delivered to the address provided by the Client. Delivery times are estimates and not guaranteed. Risk passes to the Client upon delivery.

Article 10: Liability

Botanisan’s liability is limited to the value of the order in cases of direct damage. Liability for indirect damage, such as lost profits or reputational damage, is excluded.

Article 11: Force Majeure

Botanisan is not liable for non-performance due to events beyond its control, including third-party failures and strikes.
